Privacy Notice

This Privacy Notice (“Notice”) contains rights and obligations and other important provisions regarding collecting, processing and disclosing of your personal data in the course of the application for the participation in the Wave Programme (https://waveacceleration.com/), which programme is organized by:

Hereinafter Kék Bolygó Klímavédelmi Alapítvány referred to as “KBKA”.

KBKA acts as a data controller in connection with the collecting and processing of your personal data as explained below. The processing of the herein listed personal data under this Notice is based on your voluntary and informed consent, which consent is given by you upon your or your company’s entry into Wave Programme. Your or your company’s application and thereafter potential participation in the Wave Programme is subject to your consent to the processing of your personal data as explained here. You may at any time freely revoke such of your consent without giving any explanation of it. However, please note that the revocation of your consent to the data processing by KBKA will be considered your or your company’s withdrawal from the Wave Programme.

We do not knowingly collect or maintain personal data from any person under the age of majority. Participation in Wave Programme is not available for anyone under the age of eighteen. In the event that we learn that we have collected personal data from anybody under age 18, we will delete that information as quickly as possible.

The Notice contains a detailed notification concerning the processing of the your or your company’s personal data by KBKA in accordance with regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation, “GDPR”) and Act CXII of 2011 on the Right of Informational Self-Determination and on Freedom of Information (hereinafter referred to as “Info Act”) as follows:

  1. Definitions

The following definitions are used:

(i) personal data: shall mean any information relating to an identified or identifiable natural person (‘data subject’) an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

(ii) your consent: shall mean your freely given, specific, informed, and unambiguous indication by which your, by a statement or by clear affirmative action, signifies agreement to the processing of personal data relating to you;

(iii) your objection: shall mean a declaration made by you objecting to the processing of your personal data and requesting the termination of data processing, as well as the deletion of the data processed;

(iv) controller: shall mean natural or legal person or organization without legal personality which alone or jointly with others determines the purpose and means of data processing;

makes and executes decisions concerning data processing (including the means used) or have it executed by a data processor;

(v) data processing: shall mean any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction; ns).

As stated above, KBKA is the data controller of any data which constitutes personal data and uploads by the registration form and attendance of the Wave Programme

  1. Purposes and legal basis of the data processing

2.1 Organizing the Wave Programme

KBKA will process the below personal data solely (i) to organize the Wave Programme (ii) to assure your or your company’s participation in the Wave Programme, (iii) to manage the selection of the participants picked by the jury voting, (iv) to post information about you or your company on the website of the Wave Programme (https://waveacceleration.com/) (hereinafter the “Website“).

2.2 Advertising and newsletter sending

Please note that by the registration and attendance of the Wave Programme you or your company agree that KBKA regularly sends advertising and newsletter by e-mail to your or your company’s email address given by the registration.

The legal basis of the processing of your personal data as data subject is your consent that is given by you upon your or your company’s entry into Wave Programme.

If you or your company has given consent to receive newsletters from KBKA to your or your company’s email address by its above-referred registration, you may freely withdraw your consent without any restriction and justification by using the Unsubscribe  link at the bottom of the newsletter or by a declaration addressed to KBKA, sent by post to the registered seat of KBKA.

2.3 Invites for other events organized by KBKA

KBKA can invite you by email to other events where you can decide if you are interested in participating. The legal basis of the processing of your personal data as the data subject is your consent that is given by you upon your or your company’s entry into Wave Programme

  1. List of personal data processed

In order to achieve the above purposes, KBKA processes the following personal data.

(a) In case of legal entity contestants:

To the extent they qualify personal data, KBKA processes your name and position within your company; e­mail address, telephone number, website and other social links of your company which may be directly associated with you; your company’s formation date; the name of your investor / mentor , the amount invested by him/her in your company, and other financial and business data related to your company, and about your Company’s operation.

(b) In case of individual contestant:

To the extent they qualify personal data, KBKA processes your name, age, sex, e­mail address, telephone number, website and other social links of you which may be directly associated with you; the starting date of your business activity; name of your investor / mentor, the amount invested by him/her in your activity, and other financial and business data related to your activity.

(c) In case of all types of contestants

To the extent they qualify personal data, KBKA processes your data personal data provided in the application form including but not limited to your answers provided for sections  ‘introduction of the sustainable business idea and market potential’, ‘introduction of the business model’, ‘maturity of the organization’, ‘introduction of the positive environmental impact’ or ‘other questions and information’.

Provision of any personal data of any third person by you to KBKA is subject to the collection of the appropriate consent of such third person by you to the processing of his/her personal data as described herein. That being said, by consenting to this Notice, you hereby state and acknowledge that you obtained the appropriate consent from your or your company’s investor to provide KBKA with such investor’s personal data for the data processing activities described herein. KBKA hereby exclude all responsibility relative to the existence of the appropriate consent from such investor or from any third parties to its data processing activities as explained in this Notice.

  1. Transfer /disclosure of and access to personal data

4.1 Data processor

For the purposes set out in section 2 of this Notice, KBKA utilizes the below data processor. Data processor does not make its own decisions concerning data processing; it solely proceeds based on its agreement with and upon the instruction of KBKA. KBKA entered into a data processing agreement with the data processor specifying at least the minimum requirements under Article 28(3) of the GDPR. KBKA regularly inspects the activities of the data processor.

4.2 Transfer of personal data to juries

As a condition of applicants’ participation in Wave Programme, KBKA shares the above personal data with the jury, in order that they can pick the participants of the programme. The list of the above-mentioned is available on the Website. The contestants will be informed of the name of the juries in advance.

4.3 Sharing personal data with sponsors

Upon your separate consent, KBKA may share the above personal data with the sponsors of the KBKA listed on the Website for the purpose of evaluating you or your company for proposing investment to you or to your company.

4.4 Sharing advertisements / reports and other publications

 KBKA shall be entitled, at their sole discretion, to publish advertisements and/or reports and/or other publications at its Website including that information received or obtained in relation to Wave Programme.

  1. Data security

KBKA performs tests regularly on the security systems of its servers. KBKA fixes the discovered defects without delay, its software applies state of the art security solutions in order to ensure that not only its servers but also its software is protected against intrusion. Double factor authentication, the user identification solution and the software’s data transfer functions ensure the security of the stored data.

KBKA acts with the utmost care in order to prevent data protection incidents. In the case of any data protection incidents, KBKA provides maximum transparency to the contestants and the acting authorities.

  1. Duration of data processing (retention periods)

KBKA is entitled to process the personal data listed therein for no longer than is necessary for Wave Programme to achieve the purposes for which such personal data was collected unless we are specifically required to keep such personal data longer by applicable statutory provisions of law (such as the obligatory contact details of invoices that need to kept in line with the applicable accounting laws).

In accordance with the above, in case of point  2.1 of the Notice, KBKA processes the personal data no longer than 1 year calculated from the end of the programme while in case of point 2.2. and 2.3 of the Notice KBKA processes the personal data until the consent of the data subject is withdrawn.

  1. Your rights as data subject

The data subject has the right to request access to and rectification or erasure of his personal data, the right to restrict processing, or object to processing.

7.1. Right to access

The data subject has the right to obtain from the KBKA confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and the following information: the purposes of the processing; the categories of personal data concerned; the recipients to whom the personal data have been disclosed; the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period.

7.2. Right to rectification

The data subject has the right to obtain from the KBKA without undue delay the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, the data subject has the right to have incomplete personal data completed.

7.3. Right to erasure (“right to be forgotten”)

The data subject has the right to ask for the erasure of his or her personal data. The data subject has the obligation to erase the data without undue delay where one of the following applies: (i) the data are no longer necessary for the purposes for which they were collected or processed; (ii) the data subject objects to the processing and there are no overriding legitimate grounds for the processing; (iii) the personal data have been unlawfully processed; (iv) the personal data have to be erased for compliance with a legal obligation in EU or any other applicable law to which KBKA is subject.

Erasure request may be refused for (i) for exercising the right of freedom of expression and information; (ii) for compliance with a legal obligation; (iii) for the establishment, exercise or defense of legal claims. In all cases, KBKA shall inform the data subject of the refusal of the erasure request, indicating the reason for the refusal of the erasure. Once the request for erasure of personal data has been fulfilled, the previous (deleted) data can no longer be recovered.

7.4. Right to restriction of processing

The data subject has the right to obtain from KBKA restriction of processing where one of the following applies: the accuracy of the personal data is contested by the data subject, for a period enabling KBKA to verify the accuracy of the personal data; if the data processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead; if KBKA no longer needs the personal data for the purposes of the data processing, but they are required by the data subject for the establishment, exercise or defence of legal claims.

7.5 Right to object

The data subject has the right to object at any time against the processing of his or her personal data, if such processing is necessary solely for the purposes of legal compliance of Wave Programme or the legitimate interests of KBKA or third person.

KBKA shall examine the lawfulness of the objection of the data subject and, if it finds that the objection is justified, it terminates the data processing, in stops access to the affected personal data and notifies those for who the affected personal data had been transferred.

In case the data subject objects, KBKA can no longer process the personal data unless KBKA demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of legal claims. There is no right to object the processing of data necessary for the performance of the purposes set out in this Notice.

For further information please contact KBKA by sending an e-mail to hello.wave@kbka.org or a mail to the above specified registered seat of KBKA. KBKA, as the data controller gives the written, articulate information to you as soon as possible, latest in 30 days. This is free from any charge.

If you consider your rights as a data subject have been infringed, you are entitled to turn to the the Hungarian Data Protection Office (HDPO) (Name in Hungarian: Nemzeti Adatvédelmi és Információszabadság Hatóság, address: 1125 Budapest, Szilágyi Erzsébet fasor 22/c) or you may file court proceedings against the data controller in which you may also request compensation of damages you sustained as a result of an unlawful processing of your personal data or as a result of an infringement of the security requirements of data protection.

  1. Changes to this Notice

If we change our privacy policies and procedures, we will post those changes on our Website to keep you aware of what information we collect, how we use it and under what circumstances we may disclose it. Changes to this Notice are effective when they are posted on this page.
